Note Ved. práce Vladimír Šik Abstract Tématem bakalářské práce je ?Současný vývoj a vnímání mediace mimo oblast trestní problematiky v České republice?. Mediace reprezentuje mimosoudní řešení sporů a je metodu řešení mezilidských konfliktů, při které neutrální kvalifikovaná osoba ?mediátor? pomáhá účastníkům sporu ve vzájemné komunikaci a dorozumění. Hlavním cílem mediace je dosažení spokojenosti s výsledkem obou účastníků. Do mediace v civilních sporech patří rodinná a partnerská mediace, peer mediace, obchodní mediace, mediace v pracovněprávních sporech, interetnická, kumunitní, environmentální mediace a mediace v politice a diplomacii. Práce se snaží upozornit na výhody využití mediace v oblasti sociální práce a v praktické části se zaměřuje na využití mediace při práci s klientem na oddělení sociálně právní ochrany dětí, na oddělení sociální práce, v zařízení pro okamžitou pomoc dětem, na práci rodinné mediátorky a na práci vedoucího Probační a mediační služby. V bakalářské práci se autor také zabývá vývojem zákona o mediaci v netrestních věcech, který má podle praktikujících mediátorů několik nedostatků. Jako problém shledává, že zákon ještě nenabyl účinnosti a neustále se mění za přispění mediátorů-advokátů, kteří lobbují ve svůj prospěch, a tím pádem na úkor praktikujících mediátorů bez právního vzdělání. The topic of my bachelor thesis is ?Contemporary development and perception of mediation except the field of criminal problems in the Czech republic?. The mediation represents the out of court solving of disputes and it is a method of solving the interpersonal conflicts in which a neutral qualified person ?mediator? helps to the participants of dispute in mutual communication and understanding. The main aim of mediation is the achievement of satisfaction with the results for both of them. Into the mediation in the civil affairs belong family and partner mediation, peer mediation, business mediation, mediation in industrial disputes. Furthermore are included interethnic, community, environmental mediation and mediation in politics and diplomacy. The bachelor thesis wants to attract attention to advantages of mediation in the field of social work and in the empiric part to focus on using of mediation at a work with the clients in the department of social and law protection for children, department of social work, department of immediate aid for children, on the work of family mediator and on the work of leader of the probate and mediate office. The author of the bachelor thesis deals with the development of law regarding mediation in the noncriminal disputes, which has a several shortcomings according to the mediators from practise. The last part of the thesis deal with the problem of The Czech legislation which has not yet come into force and continuously has been changing with contribution of the mediators-lawyers who fight for their own interest, unfortunately to the detriment of practised mediators who are naturally without legal education.
