Note Ved. práce Pavel Hynčica Abstract Ve své práci jsem se po obecném úvodu rozlišení prezidentského, poloprezidentského a parlamentního režimu zaměřil na analýzu debaty na téma přímé volby hlavy státu České republiky. Vycházel jsem přitom z odborných knih, časopisecké literatury i z internetových zdrojů. Zohlednil jsem jak názory odborníků (ústavních právníků, politologů), tak názory představitelů jednotlivých parlamentních politických stran. V analýze jsou shrnuty zásadní argumenty pro přímou volbu hlavy státu i proti ní. V práci je k dispozici rozbor argumentů typu: přímá volba posílí legitimitu hlavy státu, umožní zvolení politicky odpovědného prezidenta, přímá volba je řešením častých českých politických krizí, přímá volba zvýší účast občanů na věcech veřejných, atd. V konečném důsledku se v práci ukázalo, že převládají argumenty, které hovoří proti zavedení přímé volby prezidenta. S otázkou přímé volby je bezprostředně spojena i problematika úpravy prezidentských pravomocí, proto je v práci věnován velký prostor rozboru jednotlivých nástrojů k ovlivňování politické scény. kterými prezident republiky disponuje. V této části lze nalézt i komparaci pravomocí nepřímo voleného prezidenta České republiky s pravomocemi přímo voleného prezidenta Slovenské republiky. Práci uzavírá návrh změn Ústavy, které by podle mého názoru mohli být provedeny i bez zavedení přímé volby prezidenta republiky. Having first - in general - drawn distinctive lines among the presidential, semi-presidential and parliamentary regimes in my thesis, I focus my attention upon the analysis of a debate on the direct election of the head of the state of the Czech Republic. I build on findings gathered from expert publications, magazine and internet sources, taking into account both the views of experts (i.e. constitutional lawyers, political scientists), and of representatives of respective parliamentary political parties. Summed in the analysis are fundamental arguments that are both in favour of, and against, a direct election of the head of state. Available in the thesis is an analysis of arguments of the type as follows: Through a direct election, the legitimacy of the head of state will be strengthened, the election of a politically responsible President will be provided for; the direct election is the solution for the frequently occurring Czech political crises; the direct election shall increase the Participation of the public in public policy, etc. Ultimately, as it turns out in the thesis, arguments opposing the idea of introducing a direct election of the President, prevail. Closely related to the direct election concept is the issue of regulating Presidential powers. Therefore, much space in the thesis is devoted to the analysis of respective tools that are under disposal of the President of the country, and applied to affect the political scene. In the said part of the thesis, a comparison of powers of the indirectly elected President of the Czech Republic with those of the directly elected President of the Slovak Republic, is carried out. The thesis concludes with a proposal of changes to be made in the Constitution that might - in the author´s view - be made even without a direct election of the President being introduced.
