Note Lic. smlouva Abstract Tato bakalářská práce ?Švarcsystém a outsourcing" se zabývá metodami, kterými si dnešní zaměstnavatelé odlehčují své náklady na základě druhu zaměstnávání (nelegální systém, švarcsystém) a vyčleněním některých svých podnikových činností (outsourcing). V teoretické části nejprve objasňuji významy obou pojmů, vymezuji výhody a nevýhody, které souvisí s využíváním těchto metod. Dále uvádím důvody, proč zaměstnavatelé a zaměstnanci přistupují na švarcsystém a jaký je pohled ze strany státu na tento způsob zaměstnávání. Dále uvádím, jaká rizika a důsledky jsou spojena s využíváním outsourcingu. V práci zmiňuji také nelegální práci, tzv. práci na černo, poněvadž i ta je v praxi využívána jako varianta, kdy zaměstnavatel chce ušetřit veškeré povinné poplatky a daně za zaměstnance, byť je zákonem postihována. V praktické části pak porovnávám, kolik zaměstnavatel ušetří, pokud svého zaměstnance zaměstnává na základě klasického pracovního poměru či praktikuje výše zmiňované způsoby. K výsledku docházím rozdílem mezi porovnávanými možnostmi. Jestliže zaměstnavatel má se svým zaměstnancem smluvený klasický pracovní poměr, je povinen za něj odvádět daň ze mzdy a platit zdravotní a sociální pojištění. Pokud ale zvolí zaměstnávání pomocí švarcsystému (nelegální práce) či vyčlení některou svojí činnost z podnikání, pak se těmto poplatkům vyhne, tudíž ušetří. Když tedy vezmu v potaz, kolik zaměstnavatelů se v České republice takto může chovat a stát o tom nemá ve většině případů přehled, poté stát přichází ročně o nemalou částku, která by jinak zvyšovala státní rozpočet. Jako návrh bych v tomto případě doporučila státu změnu v legislativě. This bachelor thesis ?Svarc´s system and outsourcing" deals with the methods by which today´s employers to mitigate their costs by type of employment (illegal system, Svarc´s system) and earmarking some of its business activities (outsourcing). In the theoretical section first explains the meanings of both concepts, identifies the advantages and disadvantages associated with the use of these methods. Furthermore, mention the reasons why employers and employees access the Svarc´s system and what is the view from the state for this kind of employment. Further mention the risks and consequences associated with the use of outsourcing. The work also makes reference to illegal work, work on the so-called black, because even this is in practice used as an alternative, the employer wants to save all required fees and taxes for employees, even though the law punishable. The practical part will compare how much the employer will save, if an employee employed under traditional employment practices, or the above mentioned methods. The outcome I come difference between options being compared. If your employer has a traditional employee an agreed contract of employment, it is obliged to pay tax on wages and pay medical and social insurance. But if you choose employment with Svarc´s system (illegal work), or set aside any of its activities from business, then avoid these charges, thus saving. So when I take into account how many employers in the Czech Republic follows the act and the State shall not, in most cases the survey, the State comes a year after the considerable amount that would otherwise increase the state budget.
